History:  Under terms of a Settlement Agreement reached in 1999, Richland agreed to reduce the number of homes from 146 to 123 and include conditions that would address Lafayette's concerns about visibility and traffic, chiefly using revenues generated by the project's golf course to fund road and drain repairs in Lafayette.  In March 2006, Richland filed applications with Moraga eliminating the golf course. To replace the funding lost by the golf course, Richland proposed a $250,000 per year payment to be split by Moraga and Lafayette, as well as a $14 million one-time payment to Moraga for the purpose of building new recreational facilities.  Lafayette sent Moraga a letter on 4/13/06 requesting that the application be deemed incomplete because the terms of the Settlement Agreement had not been adhered to, largely because home sites are now being proposed in highly visible areas previously deemed "off-limits" and the lack of inflation adjustments in the payment stream.  On 4/14/06, Moraga Planning Director Lori Salamack made a determination that the elimination of the golf course was consistent with the Settlement Agreement.  The City of Lafayette appealed this determination to the Moraga Planning Commission on 4/28/06, which was upheld on 5/1/06. Lafayette appealed to the Moraga Town Council on 5/9/06, which upheld the Planning Commission's decision on 5/24/06.  The City of Lafayette then filed suit against the Town of Moraga, and a counterclaim has been filed against Lafayette by the developer.  The Moraga Planning Commission conducted public study sessions and hearings on 8/21/06, 9/5/06, 9/18/06, 10/2/06, and 1/16/07.  Concerns about visual impact were raised by BurtonValley.com on 10/14/06 and 2/2/07, and a letter from the City of Lafayette on 1/12/07.

Current status:  Moraga Planning Commission has scheduled a hearing for 2/5/07.

History:  The City of Lafayette articulated its concerns about potential traffic and visibility impacts for Rancho Laguna I's DEIR in March, 2004.  The revised proposal, Rancho Laguna II, was initiated in 2004 and the EIR was initiated in October, 2005.  The Draft EIR was released in July 2006, and the Moraga Planning Commission held  public hearings for comments on the DEIR on 7/17/06 and 8/7/06.

Current status:  A public workshop on the project is scheduled for 9/20/05.  The public comment period on the DEIR runs through 9/25/06.

HistoryThis is a highly visible 22 acre parcel that overlooks the Secluded Valley, both on the Lafayette (toward Acalanes High School) and Walnut Creek sides.  The Planning Commission reviewed six possible sites in 2003 and recommended Site F (facing the Walnut Creek side) on 6/3/04.  The Design Review Commission heard the application on 6/14/05 and 7/12/05, and concluded that approving a home on Site F would be difficult.  It recommended a site visit to evaluate additional sites, including one at the end of Peaceful Lane that was not one of the six evaluated previously by the Planning Commission.   

Current status:  The site visit has not yet been conducted.

History:  The applicant seeks to build a large home in a visible location within the 250-ft. Class II ridgeline setback.  Previously considered under DR31-98, that application proposed a 7500sf home on the ridgeline.  The current proposal places the home site on the ridge, roughly in the vicinity of prior Scheme 5, which is inconsistent with the Hillside Ordinance.  The Planning Commission conducted a siting hearing on 4/6/06, and referred to the Design Review Commission with the recommendation that the applicant consider moving the site lower in the saddle, explore moving the house away from the corner down the hill (elevation 858 to 846), and that the size of the house should start at 3500sf and the applicant must demonstrate that making it larger would not have any significant impacts.
